Provision for noncommercial use of
musical works by Douglas Hamilton

1) Douglas Hamilton claims full copyright ownership and protection for all musical and literary works he creates. None have been placed in the public domain.

2) The works listed in Appendix A may be posted or performed without prior arrangement under the following circumstances:

A. Access to the performance or posting must be free of charge.

B. The context must be noncommercial, which shall be defined as projects that produce no more than two thousand dollars gross revenue annually.

C. The work must be presented unaltered and in its entirety.

D. This notice must accompany the work, including the correct copyright date:

© xxxx Douglas Hamilton (doug@geektones.com). Permission is hereby granted for non-commercial posting or performance of this work provided it is not altered and that this notice appears intact. Publishing, recording, and all other commercial use requires prior permission. By distributing this work, you are indicating your acceptance of the complete, current terms of this license located at http://www.geektones.com/c.

4) The copyright owner may alter, amend, or withdraw the provisions of this agreement at any time. In that event, a 90 day grace period is hereby granted for compliance with any revised terms.

5) The copyright owner reserves the right to prohibit specific uses of his work even if they nominally fall within the applicable provisions of this agreement. In such an event, a 45 day grace period is hereby granted for compliance with any request to cease a particular use.

6) No other uses beyond those outlined in Section 2, including but not limited to recording or publishing the works, are permitted without explicit prior permission, which may be arranged by contacting Doug Hamilton, 3218 Topping Road, Madison, WI 53705. Email doug@geektones.com.

7) This agreement notwithstanding, broadcast, netcast, or other public performance of the affected works may be governed by the provisions of a performing rights organization such as BMI or ASCAP.

8) By posting, performing, or publishing the works listed in Appendix A, you acknowledge and agree to adhere to the terms of this agreement. It is your responsibility to consult this document from time to time to insure that you are in compliance with its current provisions.

9) Sorry about all this fine print -- I'm just trying to cover myself. I'm really happy if anyone is interested in this music. Let me know how you use it if you feel like it.
